Eligibility Criteria
To be eligible for refugee protection in Canada, applicants must meet specific criteria:
- Convention Refugees: Individuals outside their home country who cannot return due to a well-founded fear of persecution based on:Race

- Membership in a particular social group (e.g., gender, sexual orientation)
- Risk to their life

It’s important to note that individuals under a removal order are not eligible to make a refugee claim. Officers reviewing refugee claims determine if the case will be referred to the Immigration and Refugee Board of Canada (IRB), an independent body that decides on immigration and refugee matters.
