LMIA Requirements for Employers
To successfully obtain an LMIA, employers must:
Pay the Processing Fee: A non-refundable fee of $1,000 CAD per application is required, except for certain caregiver positions and applications supporting permanent residency.
Advertise the Job Position: The job must be advertised for at least four weeks using a minimum of three recruitment methods, including the Canadian Job Bank and two other platforms.
Demonstrate Recruitment Efforts: Employers must provide evidence of their efforts to hire Canadian citizens or permanent residents before considering foreign workers.
Submit a Transition Plan: A detailed plan outlining strategies to reduce reliance on foreign workers over time is necessary.
Provide Training Documentation: Evidence of investment in training for the hired foreign worker should be included.
Ensure No Negative Impact on Canadian Workers: Employers must demonstrate that hiring a foreign worker will not lead to layoffs or negatively affect current Canadian employees.

- Compile Required Documentation: Gather essential documents such as business licenses, commercial lease agreements, and incorporation papers to validate the business’s operational status.
- Advertise the Job: Post the job opening on the Canadian Job Bank and at least two other recruitment platforms. Document all recruitment efforts and outcomes.
- Issue a Job Offer: Once a suitable foreign candidate is identified, provide a detailed job offer letter outlining wages, working hours, and job duties. The candidate must sign this letter.
- Submit the LMIA Application: Complete the LMIA application form, attach all supporting documents, and pay the processing fee.
- Await Decision: If approved, a positive LMIA will be issued, allowing the foreign worker to apply for a work permit.
